We provide Visitors and Authorized Customers with a mechanism to delete/deactivate Personally Identifiable Information from the Site’s database by contacting . However, because of backups and records of deletions, it may be impossible to delete a Visitor’s entry without retaining some residual information. An individual who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use Personally Identifiable Information relating to that individual in any way moving forward.
What happens if the Privacy Policy Changes?
We will let our Visitors and Authorized Customers know about changes to our privacy policy by posting such changes on the Site. However, if we are changing our privacy policy in a manner that might cause disclosure of Personally Identifiable Information that a Visitor or Authorized Customer has previously requested not be disclosed, we will contact such Visitor or Authorized Customer to allow such Visitor or Authorized Customer to prevent such disclosure.

Release and Waiver
Because dance and physical exercise can be strenuous and subject to risk of injury, the Ember & Flow staff, volunteers, facility and the facility staff, urges you to obtain a physical examination from a doctor before practicing any dance moves or dance techniques.
You (each client, guest, and all participating family members) agree that if you engage in any dance or physical activity, or use any amenity on the premises or off the premises, including any sponsored event, you do so entirely at your own risk, any recommendation for dance technique or practices are entirely your responsibility, and you should consult a physician prior to social dancing or taking on any physical activity.
You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness or death. We are also not responsible for any loss of your personal property.
This waiver and release of liability includes, without limitation, all injuries, illness, or death which may occur as a result of: 1) your uses of the facility and/or the facilities amenities and your participation in any activity class, program, training or instruction; 2) the sudden and unforeseen malfunction of any equipment; 3) our instruction, training, supervision, or recommendation; 4) your slipping and/or falling while in the building or on the premise including adjacent sidewalks and parking areas; 5) contact with other participants; 6) effects of the weather, including high heat and/or humidity; and all other such risks being known and appreciated by the facility and it’s staff; 6) the actions or statements of any participant to another; 7) the consumption of alcohol before, during or after Ember and Flow events or classes, attendees are responsible for moderating their own consumption of alcoholic drinks within their own guidelines for their health and for finding alternate transportation if they become unable to drive; 8) participating fully aware of any mandates and regulations, including but not limited to COVID-19 restrictions, that are set in place and not adhering to them, and accepting others not adhering to them as well.
I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in.
After having read this waiver and knowing these facts, and in consideration of acceptance of the my participation and the services furnished to me by the facility, it’s staff and the event participants, I agree, for myself and anyone entitled to act on my behalf to HOLD HARMLESS, WAIVE AND RELEASE Ember & Flow, Miguel Mendez, Kristin Westman, facility and business owners, its leadership, volunteers, employees, organizers, participants and successors from an any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring legal action against the facility for personal injury or property damage.
I will respect this facility to the highest standards. I am responsible for any damage or theft I may cause, I will not touch anything that is not mine without permission from Miguel Mendez. I am also responsible for cleaning up after myself.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, it’s agents and employees. If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and the offending provision of provisions severed here from.
By attending Ember & Flow events and/or classes, I acknowledge that I understand this waiver and its content and that this release cannot be modified orally.

The Website is owned and operated by EmberAndFlowEvents.com (“EmberAndFlowEvents.com”). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, EmberAndFlowEvents.com’s Privacy Policy) and procedures that may be published from time to time on this Site by EmberAndFlowEvents.com (collectively, the “Agreement”).

1. Payment and Renewal.
• General Terms.
By selecting a product or service, you agree to pay EmberAndFlowEvents.com the one-time and/or monthly or annual subscription fees indicated (additional payment terms may be included in other communications). Subscription payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. Payments are not refundable.
• Automatic Renewal.
Unless you notify EmberAndFlowEvents.com before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Upgrades can be canceled at any time by submitting your request to EmberAndFlowEvents.com in writing.
2. Services.
• Fees; Payment. By signing up for a Services account you agree to pay EmberAndFlowEvents.com the applicable setup fees and recurring fees. Applicable fees will be invoiced starting from the day your services are established and in advance of using such services. EmberAndFlowEvents.com reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Services can be canceled by you at anytime on thirty (30) days written notice to EmberAndFlowEvents.com.
• Support. If your service includes access to priority email support. “Email support” means the ability to make requests for technical support assistance by email at any time (with reasonable efforts by EmberAndFlowEvents.com to respond within ten business day) concerning the use of the VIP Services. “Priority” means that support takes priority over support for users of the standard or free EmberAndFlowEvents.com services. All support will be provided in accordance with EmberAndFlowEvents.com standard services practices, procedures and policies.
3. Responsibility of Website Visitors. EmberAndFlowEvents.com has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, EmberAndFlowEvents.com does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. If you are registering a domain name, using or transferring a previously registered domain name, you acknowledge and agree that use of the domain name is also subject to the policies of the Internet Corporation for Assigned Names and Numbers (“ICANN”), including their Registration Rights and Responsibilities.
11. Changes. EmberAndFlowEvents.com reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. EmberAndFlowEvents.com may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
12. Termination. EmberAndFlowEvents.com may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your EmberAndFlowEvents.com account (if you have one), you may simply discontinue using the Website. Notwithstanding the foregoing, if you have a paid services account, such account can only be terminated by EmberAndFlowEvents.com if you materially breach this Agreement and fail to cure such breach within thirty (30) days from EmberAndFlowEvents.com’s notice to you thereof; provided that, EmberAndFlowEvents.com can terminate the Website immediately as part of a general shut down of our service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

15. General Representation and Warranty. You represent and warrant that (i) your use of the Website will be in strict accordance with the EmberAndFlowEvents.com Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
16. Indemnification. You agree to indemnify and hold harmless EmberAndFlowEvents.com, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.
